14.07.2023 sdas rejected C.R.M.(NDPS) No. 1261 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with NCB Crime No. 01/NCB/KOL/2020 under Sections 8(c ) and 20(b )(ii)(c )/29 of the NDPS Act.

And In Re : Abhishek Singh .... petitioner Mr. Soumya Basu Roy Chowdhuri ....for the petitioner Mr. Kallol Mondal Mr. Pradyat Saha ...... for the NCB Learned Counsel for the petitioner submits he is in custody for three years and seven months. It is also submitted that there is delay in trial. He prays for bail. Learned Counsel for the State opposes the prayer for bail and submits trial is in progress. One out of five witnesses has been examined.

We have considered the materials on record. Narcotics above commercial quantity i.e. 42 Kgs. of Ganja was recovered from the joint possession of the petitioner and the co-accused. Trial is in progress. Under such circumstances, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.
