Appellant is present before this Court and assisted by the learned Advocate.

Learned Advocate representing the respondents accused persons nos. 1 and 2 is present through virtual mode.

It is said by the appellant that the matter in dispute has already been settled outside of the Court and as such he does not intend to proceed further with the present appeal.

An application filed on behalf of the appellant-complainant to that effect also reveals that the matter in dispute between the parties has already been amicably settled up.

The application filed by the appellant-complainant namely, Mr. Mahesh Kr. Agarwala, is taken on record.

The instant appeal is preferred challenging the impugned judgement and order of acquittal passed by the learned Trial Court dated 19.11.2014, in connection with Case No. C-931 of 2010 corresponding to T.R. No. 978 of 2010 under Section 138 of the Negotiable Instruments Act, 1881. 7.

I have gone through the said judgement passed by the learned Trial Court and find nothing to interfere with it.

Accordingly, the instant appeal be and the same is dismissed on merit, affirming the judgement of the learned Trial Court dated 19.11.2014. 9.

Accordingly, the instant appeal being CRA 457 of 2016 is hereby disposed of.

10. Let a copy of this order alongwith Trial Court Record be sent down to the learned Trial Court immediately.
