Heard learned counsels for the parties.
Learned counsel for the petitioner submits that the petitioner is in custody for about 290 days. He has no nexus with the alleged offence.
Opposing the prayer, learned counsel for the State submits that the petitioner and 4 others entered the house of a widow and murdered her son in her presence after stealing gold ornaments therefrom. A gold ornament has been recovered from the possession of the petitioner and identified by the wife of the deceased.
I have considered the material on record. One of the co accused is still absconding. Charge sheet has been submitted.
Considering the nature and gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The application for bail is thus disposed of. Case diary be returned.
