Challan evidencing payment of deficit Court fees filed on behalf of the petitioners be kept with the record. The petitioners are Assistant Teachers at different primary schools of the District:-24-Parganas (South), they are challenging the Notification bearing No.209SE(EE)/PTTI-7/2011 dated March 4, 2013 whereby the Government of West Bengal, School Education Department (Elementary Branch), inter alia, has directed that the teachers who had obtained one year/2 years Diploma in Elementary Education from State recognized University and were appointed as Teachers on or before December 31, 2005 shall be treated as trained teacher. Ms. Gopa Biswas, learned advocate for the petitioners submits that the petitioners since were appointed in the year 2006, they are aggrieved by the aforementioned notification but during the pendency of the writ petition the Additional Secretary to the Government of West Bengal, School Education Department (Elementary Branch) has issued another notification bearing no.
323-SED-13037/69/2024ELEMN SEC dated September 4, 2024 clarifying the earlier notification that status quo regarding 'A' category scale of pay already received by the primary teachers with one year Diploma in PTTI course may be maintained for the teachers who were appointed from January 1, 2006 to
March 3, 2013, as such the grievance of the petitioners has been resolved.
In view of such development, no further order need be passed in the present writ petition.
WPA 17272 of 2024 is disposed of without any order as to costs.
