For the State The petitioners submitted a representation before the Assistant Director of Fisheries (Marine) seeking benefit under the "Centrally Sponsored National Welfare Fund for Fishermen"

in development of Model Fishermen villages. By an order passed on 30th March, 2023 in WPA 6707 of 2023, a co-ordinate Bench of this Court directed the authority to consider the said representation within a stipulated time frame. In compliance with the said order, the Assistant Director of Fisheries (Marine) Diamond Harbour, South 24 Parganas by an order passed on 7th September, 2023 observed as follows:

"i. Out of these 127 beneficiaries 125 nos. are involved in different types of fishery activities.

ii.

They are fishermen as certified by the Pradhan of Mathurapur Purba Gram Panchayat.

iii.

The conditions of their houses are poor.

iv.

The rest 02 beneficiaries were not found at the spot during inspection."

The Assistant Director sent a copy of the list to the concerned department, (i.e. the department of SHG and SE, Government of West Bengal) for necessary action. No further step was taken by the Government for which the petitioner approached this Court in a writ petition being WPA 22791 of 2023. By an order passed on 5th September, 2024, this Court directed that the prayer of the petitioner should be considered as expeditiously as possible.

Learned counsel for the petitioner submits that no consequential step has been taken by the authority till date.

In view of the above, the Director of Fisheries, Government of West Bengal, being the 2nd respondent herein, is directed to take necessary steps in terms of the order passed by the Assistant Director of Fisheries on 7th September, 2023 within four weeks from the date of communication of this order.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. The writ petition is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
