C.R.M. 7170 of 2021 (Via Video Conference) 18.02.2022 Sl. 42 Court No.29 sourav (Rejected) In Re: - An application for bail under Section 439 of the Code of Criminal Procedure filed on 28.10.2021 in connection with Entally P.S. Case No. 366 of 2019 dated 27.11.2019 under Sections 20(b)(ii)(c)/29 of the NDPS Act arising out of NDPS Case No. 101 of 2019.

And In the matter of: Gouri Das ....petitioner.

Mr. Rajeev Lochan ...for the petitioner.

Mr. Sanjoy Bardhan Ms. Baishakhi Chatterjee ...for the State.

Petitioner seeks bail.

Learned advocate appearing for the petitioner submits that he requires sometime to argue the matter. He seeks time. Learned advocate appearing for the State submits that commercial quantity of narcotic was initially seized from the possession of the husband of the petitioner. Thereafter, on the leading statement, another consignment of commercial quantity of narcotic was seized from the joint possession of the petitioner. Considering the fact that commercial quantity of narcotic was seized from the joint possession of the petitioner, we are of the view that the petitioner is unable to overcome the restrictions under Section 37 of the NDPS Act, 1985.

Consequently, the prayer for adjournment is of no consequence and need not be acceded to.

Accordingly, the prayer for bail of the petitioners is rejected. C.R.M. 7170 of 2021 is dismissed.
