04.11.2022 rp/pg Ct.16 M.A.T. 942 of 2018 Jaspal Singh Vs.

Assistant Commissioner of State Tax, Kharagpur Range & Ors.

Mr. Anirban Ray, Ld. GP Mr. T.M. Siddique Mr. Debasis Ghosh..........for the State/respondents Mr. Tapan Bhanja............for the Union of India None appears for the appellant. Mr. T.M. Siddique, learned advocate appears for the State/respondents and Mr. Bhanja, learned advocate appears for the Union of India. The appellant had filed three appeals before the Division Bench of this Court in M.A.T. 942 of 2018, M.A.T. 775 of 2018 and M.A.T. 581 of 2018. Two of the appeals i.e. M.A.T. 775 of 2018 and M.A.T. 581 of 2018 were disposed of by the Division Bench by the order 12th November, 2018 and M.A.T. 942 of 2018 was kept pending. It is not clear as to for what reason the appellant wanted the appeal to be kept pending. Upon perusing the order passed by the learned Single Bench in W.P. 15026(W) of 2018, we find that there is no error in the order for us to interfere with the same. In any event, as on date there is no appearance on behalf of the appellant. Therefore, the appeal is dismissed for default.

Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
