The petitioner has filed this Public Interest Litigation alleging large scale defalcation of public funds under the Pradhan Mantri Awas Yojana Scheme. Since the writ petition is disposed of, the allegations made by the petitioner are not gone into and is left to the decision of the concerned authority.

It is submitted that in terms of the said Scheme framed by the Central Government, the learned District Magistrate of the concerned District is the Nodal Officer. He finds that the representation through the petitioner's advocate has been sent to various authorities dated 30.06.2024 stated to have been dispatched by speed

post on 02.07.2024. However, there is no acknowledgement to show that the representation has been received by the respective noticees.

Since the petitioner alleges certain defalcation of public funds, we direct the petitioner to submit a copy of the representation dated 30.06.2024 alongwith all annexures and documents and by appearing in person in the Office of the learned District Magistrate of South 24 Parganas and submit the same in the said Office after which the learned District Magistrate shall consider the representation and make necessary enquiries by deputing appropriate authorities and take a decision on merits and in accordance with law after giving notice to all concerned and an order shall be passed to the disposing of the representation which shall be communicated to the appellant by speed post.

The District Magistrate is at liberty to call for necessary information from the concerned appellant as to whether any criminal cases have been lodged concerning the disbursement of public funds under the said Scheme. 5.

In the result, the writ petition stands disposed of. Consequently, connected application, if any, also stands disposed of.
