The petitioner is aggrieved by failure on the part of the West Bengal Cooperative Election Commission, to bring the election dispute case No. 04/CEC/2024 dated 12th February, 2024 to a logical conclusion. According to the petitioner, the respondent Nos. 9, 10 and 11 are not qualified to become the director of the respondent No. 7. Although, challenging the above, a dispute had been raised and although a notice of hearing was issued by the Secretary, West Bengal Cooperative Election Commission, on 4th March, 2024, no hearing took place on the scheduled date that is on 22nd March, 2024 as an adjournment was sought for on behalf of the respondent Nos. 9, 10 and 11. Since then, the office of the West Bengal Cooperative

WPA 17340 of 2024 Election Commission, has not taken any further steps in this matter.

Having heard the learned advocates appearing for the respective parties and noting the grievance of the petitioner, I am of the view, in the event, the election dispute case No.04/CEC of 2024 dated 12th February, 2024 has not already been disposed of, the Cooperative Election Commission should forthwith take steps and bring the said cause to a logical conclusion upon giving opportunity of hearing to the parties in accordance with law. Such decision if not already taken, shall be taken within a period of four weeks from the date of communication of this order. 3.

With the above observations and directions, the writ petition is disposed of.

It is made clear since, no affidavit-in-opposition has been called for, the allegations made in the petition are deemed not to have been admitted by the respondents.

All parties including the Secretary, Cooperative Election Commission, West Bengal shall act in terms of the server copy of this order duly downloaded from the official website of this Court.
