For the Petitioner Since the petitioner seeks expeditious disposal of her application under Section 23 of the Domestic Violence Act, 2005 pending before the learned Judicial Magistrate, 6th Court, Sealdah, the matter may be disposed of without service of notice upon the opposite parties. The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case.
It appears that the petitioner filed the application under Section 23 of the Act before the learned trial Court on 10th February, 2023. Despite several directions of the Court, the opposite parties have not filed the affidavit of assets before the Court. Learned trial Court has fixed 7th September, 2024 for hearing of the application under Section 23 of the Act and filing of affidavit of assets by the opposite parties. Since several dates have been granted to the opposite parties for filing affidavit of assets, learned trial Court is directed to deal with the application under Section 23 of the Domestic Violence Act even in the event
the opposite parties fail to file affidavit of assets on the next date of hearing fixed before the learned trial Court. The application under Section 23 of the Act be disposed of by the learned trial Court within 30 days from the next date of hearing fixed before him.
The revisional application being CRR 2791 of 2024 is disposed of.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
