Petitioner complains that in respect of two cases being Dhubulia P.S. Case No.481 of 2023 and Dhubulia P.S. Case No.482 of 2023 although investigation commenced, but till date charge-sheet has not been submitted before the jurisdictional court. Additionally, it has been contended that the petitioner is facing inconveniences because of the pendency of the criminal cases.
State has submitted a report which reflects that charge-sheet was submitted on or about October, 2023 in both the cases before the jurisdictional court. It is also reflected in the report that a Title Suit being
T.S. No.426 of 2023 is pending before the learned Civil Judge (Junior Division), Krishnagar, Nadia between the present petitioner and the private respondents.
In view of the criminal and civil cases pending between the petitioner and the private respondents, presumably there is an issue relating to conflict, as such, the police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting because of the inimical relationship existing between the parties.
With the aforesaid observations, WPA 17334 of 2024 is disposed of.
There will be no order as to costs.
Report so submitted be kept with the record.
A copy of the report be handed over to the learned advocates appearing for both the parties. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
