Supplementary affidavit on behalf of the petitioner filed in Court today be kept with the record. The petitioner complains of inaction of the Kasba Police Station in carrying out an order of injunction passed by the learned Civil Judge (Junior Division), 1st Additional Court, Alipore in T.S. No.1038 of 2021.

Learned counsel for the State has produced a report in the form of instructions issued by the Officer-in-Chrage, Kasba Police Station to the Government Pleader and the same is taken on record.

Leaned counsel for the State submits that as on the date of their visit to the premises, there was no construction going on.

Learned counsel for the respondent No.5 submits that the petitioner herein is not a party to the suit.

In view of the matter, the writ petition fails and hereby dismissed.

There shall be no other as to costs.
