Petitioners are directed to serve a copy of the revisional application upon Mr. Ghosh, learned advocate, who ordinarily appears on behalf of the State. His appointment may be regularised by the concerned authorities.

Learned advocate for the petitioners is aggrieved by further continuance of GR Case No.467 of 2015. Learned advocate for the petitioners submits that this is a case under Section 498A of IPC and other relevant sections which have been instituted against the present petitioners.

However, it reflects from the order sheet that the next date has been fixed by the trial court for examination of CSWs 3 and 4 and 2 witnesses till date have already been examined in the present case.

Having regard to the stage of the case that evidence has commenced and 2 witnesses have already been examined, I am of the view that the prayer for quashing at the stage cannot be entertained and as such the same is refused. The case was initiated in the year 2015 and the petitioners have been facing such agony for the last 8 years. The next date is fixed on 14th September, 2023 as is reflected from the records. The said date has been fixed for evidence of CSWs 3 and 4.

Having regard to the fact that the petitioners are attending the court for a considerable period of time, I direct that the learned trial court would fix at least 2 dates in a month for examination of the witnesses so that the trial of the case can be taken at the earliest. No unnecessary adjournment should be granted to either of the parties.

Learned Public Prosecutor conducting the case would ensure regarding the production of materials, documents and exhibits on the date so fixed for examination of the witnesses. Efforts be taken by all the stakeholders for concluding the trial within 31st December, 2023. With the aforesaid observations, CRR 2543 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
