The petitioner is a student of B. Sc. Computer Science (Honours) at New Alipore College, Kolkata. It is the case of the petitioner that though for her 2nd Semester examination she did not opt Mathematics as one of her papers, the university issued a mark sheet showing her absent in Mathematics paper. The petitioner, in fact, opted Physics as her paper. On the basis of a letter written by the College on May 27, 2022, the university, however, issued another mark sheet, appearing at page 23 of this writ petition, showing Physics as her third paper. In the said mark sheet also the petitioner was shown absent against the theory and practical papers of Physics.

It is the grievance of the petitioner that she duly submitted the answer script of the Physics paper and the same was uploaded on web-portal of the college as per prevalent practice during pandemic period, but the college has failed to evaluate the said paper and forward the marks obtained by her to the university. On behalf of the college, it has been submitted that there might be technical issues for which the petitioner was shown absent against the Physics paper. The college, however, fairly submits that the answer script of the Physics paper of the petitioner is lying with the college.

In the given facts, this writ petition is disposed of with a direction upon the college to evaluate the Physics paper, General Elective of 2nd Semester examination within a period of two weeks from date, if not already evaluated. After evaluation, the college shall send marks obtained by the petitioner to the Controller of Examinations of the University. The University, in turn, will issue a rectified mark sheet to the petitioner With the aforesaid directions, WPA 16402 of 2023 is disposed of.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
