Mr. Das, learned advocate appearing for the petitioner submits that the next date of this case is fixed on 3rd October, 2023. The case was initiated in the year 2018, although five years have passed. There are about 36 witnesses and till date only one witness has been examined.

I find from the records of the case that two of the Inspectors of the Food and Supplies Department, West Bengal are also accused persons. Surprisingly, the sections under which the charge has been framed is under Sections 420/120B of the Indian Penal Code although the report reflects that the rice/paddy which is a subject matter of the case is unfit for human consumption. The prosecution in this case is proceeding without any effort or any endeavour.

The DIG,CID, Bhawani Bhavan, West Bengal will monitor henceforth the progress of the case. A file would be maintained by the DIG, CID, West Bengal and a regular communication be made

with the Public Prosecutor conducting the trial of the case. In case, an witness is absent, efforts would be taken so that the witness is made available to the court on the next date so fixed. So far as the learned court is concerned, I direct that a schedule to be fixed consisting of three dates and such schedule should be fixed once in a fortnight so that the trial of the case be taken to a logical conclusion within a reasonable period of time. The public prosecutor conducting the case would beforehand give assurance regarding the availability of the materials, exhibits and documents for the purposes of the same being available on the dates fixed for examination of the witness concerned.

No unnecessary adjournments should be given to either of the parties. All effort be taken and cooperation extended to the learned court to conclude the trial at the earliest.

Mr. Mukherji, learned Public Prosecutor, High Court, Calcutta will send a copy of this order to the DIG, CID, Bhawani Bhavan, West Bengal so that steps can be taken in connection with the prosecution of the instant case.

With the aforesaid observations, the revisional application being CRR 2693 of 2022 is disposed of.
