August 20, 2025 57 ARDR (Rejected) CRM (M) 1126 of 2025 In Re : An Application for bail under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Barabani Police Station Case No. 76 of 2021 dated 01/5/2021 under Sections 363/365/364/302/201/120B/34 of the Indian Penal Code.

And In Re :

Akash Bauri @ Rintu Bauri ... Petitioner.

Adv. Ayan Basu, Adv. Sk. Salim, Adv. Sumit Routh, ... for the petitioner.

Adv. Rana Mukherjee, Adv. Md. Kutubuddin, ...for the State.

Learned counsel for the petitioner submits that the petitioner is in custody for more than four years and renews his prayer for bail.

He has been named by one of the witnesses Bishnu Sahu who was detained at the police station for three days without being forwarded to the Court. Possibility of his being tutored by the police cannot be ruled out.

Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner was last seen together with the victim prior to the alleged incident. The statements of witnesses recorded under Section 161 of the Code of Criminal Procedure implicate the petitioner. Allegation is of abduction and murder. Six witnesses have already been examined.

Considering the gravity of the offence and involvement of the petitioner therein, prayer for bail is rejected at this stage. The application for bail is disposed of.

Case Diary be returned.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
