Liberty is given to the learned advocate on record of the writ petitioner to add L.A. Collector, North 24 Parganas as a party respondent by making necessary insertion in the cause title of the instant writ petition positively in course of this day in Court.

The affidavit-of-service as filed today on behalf of the writ petitioner is taken on record.

The writ petitioner is aggrieved on account of nonpayment of compensation by the respondents/authorities in respect of his plot of land, particulars of which have been mentioned in paragraph no. 4 of the instant writ petition which according to the writ petitioner was taken possession by the respondent/State on 13.06.2008 whereas the writ petitioner became the owner thereof by virtue of a registered deed of gift dated 22.08.1996.

Such contention is, however, opposed by the learned advocate for the State as well as learned advocate appearing on behalf of the respondent no. 3 and its instrumentalities.

In view of such, this Court while disposing the instant writ petition directs the added respondent no. 8 i.e., the Special Land Acquisition Officer, North 24 Parganas to consider a copy of the instant writ petition as a representation of the writ petitioner. The added respondent no. 8 is further directed to give a chance of hearing to the writ petitioner and/or his authorized representative and, thereafter, he shall pass a reasoned order and shall forthwith communicate the same to the writ petitioner preferably by mail, if the email details of the writ petitioner is provided to him at the time of hearing.

The entire exercise as indicated in the foregoing paragraph is to be completed by the added respondent no. 8 positively within 60 working days from the date of communication of the server copy of this order together with a copy of the instant writ petition along with all annexures.

The time limit as fixed by this Court is mandatory and peremptory.

Liberty is given to the learned advocate on record for the writ petitioner to communicate the server copy of this order to the added respondent no. 8/authority. 9.
The respondent no. 8/authority is hereby directed to act on the basis of the server copy of this order.
10. With the aforementioned observations, the instant writ petition being WPA 16456 of 2025 is disposed of. 11.
Before parting with, it is, however, made clear that in the event, the added respondent no. 8 finds sufficient merit in the representation of the writ petitioner, he shall forthwith take appropriate steps for disbursement of adequate amount of compensation to the writ petitioner in accordance with law.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all the necessary formalities.
