Court No.7.

AB/PG CRR No. 2229 of 2021 In the matter of : Jakir Gazi & Anr.

......Petitioners.

Mr. Sumanta Chakraborty ...for the Petitioners.

Mr. Swapan Banerjee, PP in-charge, Mr. Suman De ....for the State.

This is an application seeking an expeditious disposal of a proceeding in which charges were framed under Sections 21(c)/ 29 of the Narcotic Drugs and Psychotropic Substances Act.

A copy of the application is served upon Mr. Swapan Banerjee and Mr. Suman De, learned Counsels, who ordinarily appear on behalf of the State and are present in Court today. Their engagement may be regularized in course of the day. Learned Counsel appearing on behalf of the petitioners submits as follows. The petitioners are accused in this case. They were arrested on 17.10.2019, the date on which the FIR was registered and since then they are languishing in custody. The charge sheet was submitted citing six prosecution witnesses. The next date before the learned Trial Court has been fixed as 8.9.2021 without specifying which of the witnesses are to be examined on that date. The petitioners are suffering

custody for more than two years. Accordingly, a direction may be passed to expedite the proceeding.

Learned Counsel appearing on behalf of the State, in his usual fairness, submits that the State would not come in the way if a direction is passed for an expeditious disposal of the proceeding.

I have heard the submissions of the learned Counsels appearing on behalf of the petitioners and the State and have perused the revision petition.

It appears that a significant delay has been caused in concluding the proceeding, especially keeping in mind the period of incarceration already suffered by the petitioners. In view of the above, I request the learned Trial Court to conclude the proceeding as expeditiously as possible without granting any unnecessary adjournment to any of the parties, preferably within a period of eight months from the next date of hearing.

With the observations, the revisional application is disposed of.

Urgent Photostat Certified copy of this order, if applied for, be supplied expeditiously after complying with all necessary legal formalities.
