Mr. Subhamoy Bhattacharya Ms. Palllavi Priyadarshee ... For the State Learned counsel for the petitioner submits that the petitioner is in custody for about 6 months upon being falsely implicated in this case. It is alleged that the bank account of the petitioner was used for depositing an amount of Rs.2 lakhs and odd by the defacto complainant. The said bank account has been frozen. The amount is, therefore, secured. Charge sheet has been submitted. Further detention of the petitioner is not required.

Learned counsel for the State opposes the prayer. I have considered the material on record. It appears that the petitioner duped the defacto complainant of a huge sum of money amounting to more than Rs. 2 lakhs in the garb of installing an ATM machine in the premises of the defacto complainant for a monthly rental of Rs. 25,000/-.

The defacto complainant was asked to pay the said sum of Rs. 2 lakhs and odd in a bank account which was prima facie found to be of the petitioner.

Learned counsel for the State submits, on instructions, that the petitioner has duped several other persons in a similar manner and complaints have been lodged against him whichdzs are under investigation. Considering the nature of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is disposed of.
