It is explained in the report dated December 6, 2021 that on the 27th October, 2021, he was deployed to monitor the Bye Election to the 127Gosaba(SC) Legislative Assembly Constituency, 2021. It further appears that the said Mr. Das is now engaged as a Municipal Returning Officer for Municipal Elections to the Kolkata Municipal Corporation.

It is further stated by Mr. Das that he would be available to carry out the orders of the District Magistrate on December 24, 2021 at about 11.30 am.

The Officer-in-Charge, Shakespeare Sarani Police Station shall render all assistance to the said Mr. Das to take possession of the secured assets and carry out the order of the District Magistrate on the abovementioned date and time. It is submitted that the costs towards such protection has already been deposited to the police.

The report dated December 6, 2021 in the form of instructions addressed to the learned Government Pleader, is taken on record.

With the aforesaid observations, the writ petition shall stand disposed of.

The personal presence of Mr. Das is dispensed with.

There shall be no order as to costs.

Urgent photostat certified copy of this judgment, if applied for, be given to the parties upon compliance of all formalities.
