Mr. Probal Kumar Mukherjee, Senior Advocate Ms. Shebatee Datta, Ms. Shaoni Dey ...for the petitioners A direction to secure expeditious disposal of Title Suit No.34 of 2010, pending before the learned Civil Judge (Junior Division), 2nd Court, at Barasat, is the ultimate relief sought for in this case.
Admittedly, this is a suit for eviction of licensee. The suit was instituted in the year 2010.
It is submitted by Mr. Mukherjee, learned Senior Advocate appearing for the petitioners that at the stage of cross-examination of D.W.3, an interlocutory application has been preferred under Order 22 Rule 10 C.P.C., and the disposal of the suit is getting delayed due to the pendency of this interlocutory application. No other point is raised requiring address by this Court.
In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.
Service upon the opposite parties stands dispensed with.
Accordingly, learned Civil Judge (Junior Division), 2nd Court, at Barasat, North 24 Parganas in Title Suit No.34 of 2010, is requested to ensure expeditious disposal of the suit, after causing disposal of the interlocutory application referred hereinabove, under Order 22 Rule 10 C.P.C., providing sufficient opportunity of hearing to either of the parties to this case, but without granting any unnecessary adjournment, unless it is extremely unavoidable, preferably within April, 2023.
Petitioners are directed to make communication of this order to the learned court below as well as to the opposite parties and their learned advocate in the court below.
With this observation/direction, the revisional application stands disposed of.
Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
