1. Report filed on behalf of the State is taken on record.

2. Learned counsel appearing for the petitioners submits that apart from the statement of a co-accused there is no other incriminating material available against the petitioners.

3. Learned counsel appearing for the State relies on the case diary as well as the report and submits that other than the statement of the co-accused there were phone calls made between the present petitioners and the co-accused at the relevant time.

4. In view of the materials available in the case diary, the phone calls made between the principal accused and the other co-accused at the relevant time and in view of the restrictions contained in Section 37 of the NDPS Act, I do

not consider this to be a fit case to grant anticipatory bail to the petitioners.

5. Accordingly, the application for anticipatory bail is rejected.

6. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
