For the State Having heard learned advocates appearing for the petitioner and the State and having considered the fact that no contraband was recovered from the possession of the petitioner and that the petitioner is sought to be implicated on the basis of the statements of the co-accused, we are of the view that the petitioner is able to overcome the restrictions under Section 37 of the NDPS Act, 1985. Considering the materials in the case diary, we are inclined to grant anticipatory bail to the petitioner. Accordingly, we direct that in the event of arrest, the petitioner shall be released on anticipatory bail upon furnishing a bond of Rs.

regular bail within four weeks from date and on further condition that the petitioner shall meet the Investigating Officer once in a month.

Prayer for anticipatory bail is allowed.
