For the State Two petitioners have filed the present writ Court No. 24 14.12.2021 (Item No. 23) (AB) petition being aggrieved by the inaction on the part of the Board by not giving appointment to them upon condoning their over age and also for not providing TET pass certificate and not publishing the merit list. The learned advocate representing the West Bengal Board of Primary Education submits that the Board has not issued the TET qualified certificate to any of the candidates till date. It has further been submitted that the documents relied upon by the petitioners at pages 23 and 24 of the writ petition are the only documents relied upon by the Board for the purpose of verifying the TET qualification of a candidate.

It appears from the submission made on behalf of both the parties that both the petitioners are untrained candidates. They are not eligible for being appointed as Primary Teachers as per the prevailing rules.

Accordingly, the prayer of the petitioners for appointment as Primary Teachers by condoning their over age cannot be accepted by the Court.

The writ petition fails and is hereby dismissed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
