The petitioner is aggrieved by the fact that in spite of information being furnished, although Katwa Police Station Case No. 196 of 2025 was registered for investigation under the relevant provisions of BNS, yet the police authorities are not effectively investigating the case. According to the learned advocate appearing for the petitioner, the same is further fortified by the fact that none of the accused persons are being traced out in spite of anticipatory bail being not pressed by the accused persons before the learned Sessions Judge.

Learned advocate appearing for the State, on the other hand, submits that all efforts are being made by the investigating agency to unearth the truth and it is a fact that the petitioner being the de facto complainant has been deceived. Efforts are being put in by the police authorities for tracing out the accused persons.

Having considered that the case was registered on 18.03.2025 and more than four months have passed, I direct the police authorities to send a progress report to the de facto complainant/petitioner. Further, the Additional SP/SDPO in-charge of Katwa Police Station would peruse the case diary and would address the issues, if there are any shortcomings in the investigation.

In case any application is filed before the jurisdictional court by the petitioner in respect of any threats being received by him which has resulted insecurity, learned Magistrate would call for a threat perception report and pass necessary directions as he deems fit and proper under the Witness Protection Scheme, 2018.

With the aforesaid observations, the writ petition being WPA 16421 of 2025 is disposed of. There will be no order as to costs.
