Petitioners claim to be share croppers and are being prevented from cultivation by the managing committee of the school wherein they claim to have been cultivating for a considerable period of time. Learned advocate for the private respondent nos.4 and 5 submits that unnecessary interference is being created in the school activities at the behest of the petitioners which is disturbing the peaceful environment of the school being carried out.

State has submitted a report and it is contended that the documents which are in possession of the petitioners in spite of being informed have not been placed before the police

authorities. Accordingly, police authorities are unable to extend their assistance.

Be that as it may, police authorities have already drawn up proceedings under Section 126 of the BNSS. Having considered that the proceedings under Section 126 of the BNSS have been drawn up, police authorities would ensure that there is no breach of the peace and/or tranquility and/or untoward incident resulting because of the strained relationship existing between the petitioners and the private respondents.

With the aforesaid observations, WPA 16429 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
