Mr. Syed Nasim Aejaz ....for the petitioner Despite service of notice, neither the private respondent nor the State are represented.

The writ petitioner is aggrieved that notwithstanding complaint to the K.L.C. Police Station, South 24 Parganas, no steps have been taken to prevent the private respondent from effecting construction over the petitioner's property. The petitioner claims to be son of the recorded 'Bargadar' of the piece of land.

It is clear from the documents on record that the dispute between the petitioner and the private respondent is purely civil in nature. The petitioner may seek civil remedies in that regard. The Officer-in-Charge, K.L.C. Police Station, South 24 Parganas shall, however, ensure that there is no breach of peace in the area.

With the aforesaid observations, the instant writ petition shall stand disposed.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
