Learned advocate appearing for the petitioner submits that, the petitioner is in custody in excess of 600 days. He submits that, other co-accused are on bail. He draws the attention of the Court to the order rejecting the prayer for bail. He submits that, no specific role can be attributed to the petitioner in the incident.

Learned Public Prosecutor appearing for the State submits that, the petitioner was in contact with the two principal accused over telephone. Call record details show that the petitioner called the two of the co-accused pre-occurrence and post-occurrence. He submits that, two other co-accused, who are similarly situated as that of the petitioner were not granted bail by the Coordinate Bench.

Considering the materials in the case diary and considering the fact that the trial is at an advanced stage and considering the gravity of the offence and considering the role of the petitioner therein, we are unable to grant bail to the petitioner.

Accordingly, prayer for bail of the petitioner is rejected and the application being CRM 7218 of 2021 is dismissed. (Debangsu Basak, J.) (Ananda Kumar Mukherjee, J.)
