Mr. Rajesh Singh, learned Counsel appearing on behalf of the appellant undertakes that the appellant shall put in the special messenger costs for bringing the lower court records within two weeks from date.

Accordingly, we direct the appellant to put in the special messenger costs for bringing the lower court records positively within two weeks from date.

Upon such costs being deposited, the department shall take immediate steps to bring the lower court record so as to make the appeal ready for hearing. In default, the appeal shall stands automatically dismissed without any further reference to Court. (Aniruddha Roy, J.) (Soumen Sen, J.)
