Mr. Pannalal Bandopadhyay ... for the State The petitioner who has been an applicant for permit under the town service route from "Purtabhavan to Nawabhat bus Stand via birhata, Railway Station, Golapbag", has been granted Offer Letter dated 5th January, 2023. The same is granted pursuant to the resolution dated 3rd December, 2022 by the Regional Transport Authority, Purba Bardhaman. Subsequently it transpires from the record that the life time of offer has been extended upto 31st December, 2023 and the writ petitioner within the said period that is on 27th December, 2023 has submitted the
document as well as produced the vehicle, before the authorities.
The writ petitioner is aggrieved that in spite of him having complied with all the formalities within the extended period of time as above, no permit has been issued to him.
Mr. Bhattacharya, for the petitioner, has stated that the petitioner, after completion of all statutory formalities for grant of permit, is eligible to receive the same.
The writ petitioner has also submitted a letter dated 27th December, 2023, before the authorities, seeking redress of his grievances.
Mr. Deb Roy is appearing for the respondent. He is of the opinion that the offer letter would have been extended till six months period and not beyond, from the date of issuance of the offer letter as per provision of the statute.
In a way, the State has doubted and raised question as regards legality and validity of the extension granted in respect of the offer letter dated 5th January, 2023.
After considering the relevant facts and circumstance of the case I find it proper to dispose of this writ petition directing the respondent authority, that is, respondent no. 3, to consider the petitioner's representation dated 27th December, 2023
and dispose of the same by dint of a reasoned order.
In doing so, the respondent authority shall grant opportunity of hearing to the petitioner. The exercise as above shall be concluded within a period of six weeks from the date of communication of copy of this order to its office.
The decision of the authority shall be communicated to the petitioner within one week from its date.
The writ petition being WPA 17356 of 2024 is disposed of.
