1. Appellant no. 1 is represented by the learned Advocate.

2. Appellant no. 2 is not represented.

3. Learned Advocate representing the State is present.

In pursuance of the direction passed by this Court a report is submitted by the Superintendent of Presidency Correctional Home indicating that both the appellants were released after serving out the sentence as passed by the learned Trial Court in the impugned judgment and order of conviction dated 13.05.2005.

5. The report submitted by the Superintendent of Presidency Correctional Home is taken on record.

6. As both the appellants have already served out the sentence as passed by the learned Trial Court in the impugned judgment and order of conviction, the present appeal becomes infractuous.

7. Accordingly, the present appeal be and the same is hereby dismissed affirming the impugned judgment and order of conviction passed by the learned Trial Court dated 13.05.2005 in connection with ST No.

1(12) corresponding to S.C. No. 51(1) 03.

8. Consequently, the application being CRAN 2 of 2006 (Old No. CRAN 1607 of 2006 is hereby disposed of.

9. Let a copy of this order along with the Trial Court Records be sent down to the Trial Court immediately.
