The writ petition is aggrieved by threats received from the private respondents who are accused persons in FIR No.1102 of 2021 dated 29th September, 2021 under Sections 498A/302/304B/34 of the Indian Penal Code and under the provisions of the Dowry Prohibition Act. The victim daughter died within three years of marriage. Counsel for the State submits that investigation has commenced and two of accused have been arrested. It is submitted that the accused persons are powerful and are continuously threatening the writ petitioner into withdrawing the complaint against them.
The allegations are denied by the private respondent. Be that as it may, the Officer-in-Charge Behrampore Police Station is directed to complete the investigation within 45 days and submit charge-sheet before the Judicial Magistrate.
The Behrampore Police Station shall also provide security to the petitioner so that he is not anyway disturbed by anybody. The petitioner shall continue to co-operate with the investigation. The Behrampore Police Station shall provide protection to the petitioner for a period of 10 days from date. Thereafter the Inspector-n-Charge of the Behrampore Police Station shall render all assistance to the petitioner as and when requested and a regular vigil shall be kept at his premises.
Counsel for the private respondents undertakes to abide by this order.
With the aforesaid observation, WPA 17526 of 2021 is disposed of.
The report of Behrampore Police Station dated 21st November, 2021 is taken on record.
Urgent photostat certified copy of this order, if applied for, be given to the parties on completion of usual formalities.
