Heard the learned Advocates for the parties.

We have considered the materials on record. Bail prayer of the petitioner was rejected earlier. Delay in the matter of framing of charge is due to systemic reasons. Date has been fixed for consideration of charge on 19th July, 2023.

Under such circumstances and in view of materials on record showing recovery of narcotics above commercial quantity i.e. 2.545 kgs. of heroin from the petitioner, we are not inclined to grant bail to the petitioner at this stage. Accordingly, the prayer for bail of the petitioner is rejected.

We request the trial court to frame charge on the date so fixed and if it is unable to do so, positively within a fortnight from date. Upon the charge being framed, trial be

concluded within two years from the date of framing of charge without granting unnecessary adjournment to either of the parties.

Parties shall communicate this order to the trial court for due compliance.
