Farhad Ali v. State Of West Bengal
17.07.2023 sdas rejected C.R.M.(DB) No. 2815 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Islampur Police Station Case No. 497 of 2022 dated 07.11.2022 under Sections 364A/34 of the Indian Penal Code.
And In Re : Farhad Ali .... petitioner Mr. Tapodip Gupta ....for the petitioner Mr. Neguive Ahmed, learned APP Ms. Amita Gaur ...... for the State Learned Counsel for the petitioner submits that coaccused from whom boy was recovered was enlarged on bail. He prays for bail.
Learned Counsel for the State opposes the prayer for bail and submits victim was kidnapped and ransom was demanded. Part of ransom was credited in the account of the petitioner.
We have considered the materials on record. Though victim has already been recovered, incriminating materials i.e. transfer of ransom money in the account of the petitioner is placed before us. This establishes involvement of the petitioner in the offence of kidnapping of the victim and demanding ransom. Under such circumstances, we are not inclined to grant bail to the petitioner at this stage.
The application for bail is, thus, rejected.
