Roy .... for the CESC Learned counsel for the petitioner contends that the respondent nos.4 and 5, in tandem, are trying to oust the petitioner from the premises occupied by the petitioner lawfully.

Since the electric supply, which is derived from the electric meter situated on the premises of the private respondents, has been disconnected, the petitioner seeks a new electric connection in the petitioner's own name.

Learned counsel appearing for the CESC, on instruction, submits that otherwise there is no impediment in granting such electric meter, subject to

the clearance of all prior dues and compliance of other formalities.

Since, despite substantial service, none appears on behalf of the private respondents, the petitioner is directed to file the affidavit-of-service during the course of the day.

Accordingly, WPA No.17528 of 2021 is disposed of by directing the respondent nos.1 and 2 to give new electric connection in the name of the petitioner as per the application of the petitioner, subject to compliance of all due formalities, including clearance of all dues in respect of the meter-in-question, by the petitioner. The Officer-in-Charge of the Phoolbagan Police Station, being the respondent no.3 herein, shall provide adequate police protection to the officials of the respondent nos.1 and 2, at the cost of the petitioner, in the event the respondent no.3 is approached by the respondent nos.1 and 2 and/or their officials for giving effective connection to the petitioner in terms of this order.

The parties shall act on the written communication of the learned Advocates for the parties, accompanied by a server copy of this order, without insisting upon prior production of a certified copy thereof.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
