Mr. Arijit Ganguly, learned advocate appearing for the State submits a report which has been prepared by the Deputy Commissioner of Police, South Suburban Division, Kolkata. Let the said report dated 25.02.2024 be kept with the record.

The concerned senior officer of police has detailed regarding the steps taken by the police authorities. The present is a complaint case which was instituted before the learned Judicial Magistrate, 2nd Court, Alipore being A.C. Case No. 2735 of 2016. More than seven years have passed, but till date nothing has progressed in the said case. Having considered that the police authorities are at present exhausting their efforts for finding out the accused person and his business hide out at Varanasi, I am of the view that regular compliance report be submitted before the learned Judicial Magistrate, 2nd Court, Alipore in respect of the updates so far as steps are taken by the police authorities for finding out the accused.

Learned Magistrate on receiving the execution report would proceed for the next step i.e. Sections 82 and 83 of the

Code of Criminal Procedure. Learned Magistrate is directed to fix at least one date in a month for the purposes of the present case so that regular progress made by the police authorities be submitted by way of a report before the said court.

With the aforesaid observations, the revisional application being CRR 2561 of 2023 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
