Mr. Kishore Mukherjee, Ms. Dipanwita Gupta ...for the petitioner Petitioner herein has prayed for a direction upon the Court below for expeditious disposal of A.C.G.R. Case No.3579 of 2018 presently pending before learned Judicial Magistrate, 4th Court at Alipore.

Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the FIR was initiated on 15.07.2018 and after completion of investigation, police submitted charge-sheet on 21st August, 2018. Prosecution proposes to examine six witnesses, out of which only one witness has been examined so far and the next date has been fixed on 09.12.2026. Accordingly, petitioner seeks for necessary direction upon the Court below.

Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite parties will have no cause to prejudice and, as such, service of copy of application upon the opposite parties is dispensed with. Having considered submission made on behalf of the petitioner and also considering the fact that since submission of

charge-sheet, 8 years have already passed and only one witness has been examined so far, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice.

In view of above, the instant application being CRR 3175 of 2025 is hereby disposed of with a direction upon the Court below to prepone the next date and to fix a date in the month of August and thereafter proceed with the trial as expeditiously as possible and to conclude the same preferably within a period of six months thereafter without granting any unnecessary adjournment to either of the parties.
