596/2023 dated 21.11.2023 under Sections 21(c)/25/29 of the NDPS Act, 1985.

And In the matter of: - Taposh Debnath ...petitioner.

Mr. Milon Mukherjee, Ld. Sr. Adv.

Mr. Biswajit Manna Mr. Saptarshi Banik ...for the petitioner.

Mr. Debasish Roy, Ld. PP Mr. Prasun Kumar Datta Ms. Eshita Dutta ...for State.

Dictated by Arijit Banerjee, J.

1. The petitioner claims parity citing an order dated November 8, 2024, passed by the Hon'ble Supreme Court of India in Criminal Appeal No. 4502 of 2024, whereby a co-accused person, namely Debanjan Saha @ Sagar @ Sahib was enlarged on bail. The petitioner says that he stands on the same footing as Debanjan Saha @ Sagar @ Sahib.

2. While opposing the prayer for bail learned Public Prosecutor, in his usual fairness, does not dispute that this petitioner and the said Debanjan Saha @ Sagar @ Sahib are similarly circumstanced.

3. Hence, on the ground of parity, we allow the petitioner's prayer for bail.
