Petitioner Mr. Shibaji Kumar Das Ms. Rupsa Sreemani Ms. Suranjana Bhattacharyya ... for the Petitioner The petitioner is directed to serve a copy of this revisional application upon Ms. Debjani Sahu, Learned Advocate, who appears on behalf of the State. Her appointment may be regularised by the concerned authority. Mr. Das, Learned Advocate, appearing for the petitioner submits that the petitioner is in custody since April, 2022. Charge-sheet has been submitted and charge has been framed.

In fact, it is submitted that majority of the witnesses have been examined but next schedule is fixed on 1st August, 2023 for the examination of P.W. 8, 9 and 10. It has also been submitted by Mr. Das that all these witnesses belong to the Police Department.

The Charge-sheet of this case reflects that the Learned Trial Court has been proceeding and progressing

with the instant case with best efforts and giving effect to the spirit of Article 21 of the Constitution of India. In view of the speed at which the Learned Trial Court has been very competently progressing with the instant case, I would request in this case that the Learned Trial Court would pass direction(s) upon the Superintendent of Police/Commissioner of Police for ensuring the appearances of the witnesses so fixed in the schedule of August, 2023. The Trial Court with the co-operation of the petitioner would try to complete the prosecution witnesses within a month thereafter.

The Learned Trial Court would thereafter complete the examination under Section 313 of the Code of Criminal Procedure prior to the ensuing Puja Vacation. Mr. Das, submits that in this case the defence will not adduce any evidence and in case, the defence will not tender any witness, the Learned Trial Court would try to pronounce the verdict as early after the ensuing Puja Vacation preferably by 15th of December, 2023. The Learned Lawyers participating should cooperate with the Learned Trial Court and the trial should proceed in spite of any resolution taken by the local Bar. With the aforesaid observations, CRR 2563 of 2023 is disposed of. Pending application(s), if any, is also disposed of.
