01.08.2025 Court No.17 SK
IN THE HIGH COURT AT CALCUTTA
CONSTITUTIONAL WRIT JURISDICTION WPA 16477 of 2025 Sri Dipak Mani Das Vs.
The State of West Bengal & Ors.
Mr. Mukteswar Maity, Ms. Manika Sarkar ... for the Petitioner.
Mr. Supratim Dhar, Sr. Adv., Mr. Santimay Bhattacharyya ...for the State.
Affidavit-of-service filed on behalf of the petitioner be kept with the record.
An order under Section 4 of the Public Land (Eviction of Unauthorized Occupants) Act, 1962 is under challenge in the instant writ petition. The order is open to appeal under Section 7 of the said Act of 1962.
In view of the availability of such efficacious alternative remedy by way of appeal, the writ petition is not maintainable. W.P.A. 16477 of 2025 is dismissed as such without any order as to costs.
However, it is made clear that this Court has not gone into the merit of the writ petition.
Parties to act on the server copy of this order duly downloaded from the official website of this Court. Urgent Photostat certified copies of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
