Learned Advocate for the petitioner submits that the petitioner's son who is the victim Tiljala p.s. case no. 105 of 2024 dated 1.4.2024 under Section 307/34 of the Indian Penal Code was seriously assaulted by the opposite party no. 2 and 3.
Learned Advocate further submits that as the police authority was not investigating the case properly a writ application was moved before this Hon'ble court and a learned single judge of this Hon'ble court disposed of WPA 12022 of 2024 by directing investigation of the case to the be forthwith transferred to the Anti Rowdy Section, Kolkata Police, Lalbazar and be carried out by the Officer-in-charge of the said section. The investigation was directed to be monitored by the Joint Commissioner of Police(crime).
Pursuant to the direction of this court passed in the writ petition the accused persons surrendered and obtained bail from learned
Additional chief Judicial Magistrate, Alipore by order dated 23.04.2024.
The petitioner being aggrieved by such order filed an application for cancellation of bail before the said learned court and the same is still pending from 3.05.2024.
As the relief sought for in this application is for expeditious disposal of the application for cancellation of bail obtained by opposite party nos. 2 and 3 no fruitful purpose will be served in keeping the application pending and directing service of notice upon the opposite parties.
Thus this application is disposed by requesting the Additional Chief Judicial Magistrate, Alipore to dispose the application for cancellation of bail in connection with Tiljala P.S. Case no. 105 of 2024 dated 1.4.2024 under Section 307/34 (ACGR -1700/24) within a period of four weeks from the next date fixed without granting any unnecessary adjournment.
