Mr. Anirban Ray, ld. Government Pleader, Mr. Debasish Ghosh ...for the State Affidavits have been exchanged on the contempt application. Exception has been filed to the report of the alleged contemnors. A sum of Rs. 1,39,000/- has been paid towards the wages payable to the petitioner during incarceration at eight several correctional homes. Mr. Ahmed, learned counsel for the petitioner submits that the actual amount payable to the petitioner, based on the period and the time spent in the correctional homes, would be much more that the petitioner was paid. The actual amount payable should be above Rs. 4 lakhs. This Court is of the view that the exact quantum of money payable to the petitioner cannot be gone into in a contempt application since it appears prima facie to this Court that some payments appear to have been made in terms of order dated September 6, 2021. The State contends that all payments due have been made.

In that view of the matter, the contempt application being CPAN 786 of 2021 shall stand disposed of. Liberty is, however, reserved to the petitioner to take out appropriate proceedings on the quantum of wages payable to the petitioner as opposed to the amounts has already been paid, in the instant proceedings. The personal presence of Mr. Peeyush Pandey, the Inspector General, Correctional Services, West Bengal and Mr. Binod Kumar Singh, Superintendent of Police, being the alleged contemnors, is dispensed with. Rule, if any, shall stand discharged.

There shall be no order as to costs.
