The petitioner prays for expeditious disposal of Guardianship Case No.41 of 2020, which is pending before the learned District Judge, Murshidabad.
It is submitted that an application praying for publication of notice in a daily newspaper has not yet been heard.
The petitioner also prays for expeditious disposal of the application.
An order of expeditious disposal of any litigation enures to the benefit of all the parties and hence prior service of this revisional application upon the opposite party is not required. The prayer is innocuous.
Under such circumstances, the revisional application is disposed of with a direction upon the learned court below to dispose of the application within a period of two months from date of communication of this order. As the next date has been
fixed on January 30, 2024, the petitioners are granted liberty to file a put up petition annexing this order, upon service of such petition to the opposite party and pray for pre-ponement of the date of hearing of the application. Thereafter, the guardianship case shall be disposed of expeditiously. Unnecessary adjournments shall not be granted to any of the parties.
This Court has neither gone into the merits of the application nor into the merits of the guardianship case. A copy of the revisional application along with a server copy of this order be served upon the opposite party within a week.
The revisional application is, thus, disposed of. There will be, however, no order as to costs. Parties are to act on the basis of the server copy of this order.
