Learned senior advocate appearing for the State draws the attention of the Court to the contents of the case diary. She submits that, the victim girl refused medical. The de-facto complainant is now stating that she does not want to proceed with the case.

The de-facto complainant is represented.

Considering the materials in the case diary and considering the gravity of the offences and the involvement of the accused in the incident and considering the statement recorded under Section 164 of the Code of Criminal Procedure of the victim girl, we are unable to grant bail to the petitioner.

Accordingly, prayer for bail of the petitioner is rejected and the application being CRM 7235 of 2021 is dismissed. (Debangsu Basak, J.) (Ananda Kumar Mukherjee, J.)
