1. Supplementary affidavit filed in Court today is taken on record.

2. The petitioner's representation alleging illegal encroachment over the Government land is pending consideration before the Sub Divisional Officer, Contai.

3. Learned advocate representing the private respondents denies the allegation of unauthorised construction.

4. Without entering into the merits of the allegations and counter allegations of the parties, the instant writ petition is disposed of by directing the Sub Divisional Officer, Contai to consider and dispose of the representation filed by the petitioner

in accordance with law after giving reasonable opportunity of hearing to all the necessary parties by passing a reasoned order at the earliest but positively within a period of twelve weeks from the date of communication of this order.

5. Learned advocate for the petitioner is directed to forward all relevant documents to the aforesaid respondents at the time of communicating the order of the Court.

CAN 1 of 2025 1.An application for substitution of the deceased respondent no. 13 has been filed. It appears that the heirs of the deceased have not been brought on record. The petitioner intends to implead the person who is in possession of the subject land as party respondent. Such prayer cannot be allowed.

2. The application stands dismissed.

3. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
