Binayak Chatterjee v. State Of West Bengal And ORS.
C.R.R. 2237 of 2021 Court No.
Item 4 Ssi In the matter of:- Binayak Chatterjee 17.02.
(via video conference) Mr. Devi Priya Mitra Mr. Dhiman Ray Mr. Dip Chanda ...for the petitioner Mr. S. S. Imam Mr. Arabinda Manna ...for the State Affidavit of service filed on behalf of the petitioner is taken on record.
This is an application seeking an expeditious disposal of a proceeding in which a charge-sheet was submitted under Sections 406, 409, 419, 420,467, 468 and 471 read with Section 120B of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the defacto-complainant in this case. Although he filed the First Information Report on 02.08.2018, till date no further steps have been taken except for filing of the charge-sheet. The proceeding has remained pending for no fault of the present petitioner.
Learned counsel for the State submits that no
inordinate delay appears to have taken place in this case.
I have heard the submissions of the learned counsels appearing on behalf of the petitioner and the State and have perused the revision petition. No prejudice will be caused to any one if a direction is passed in respect of an application seeking expeditious disposal of a proceeding.
It appears from the order-sheet that a petition under Section 173 (8) of the Code was filed in this case. However, no further order-sheet is annexed after 03.09.2021 to show what happened to the said application.
In any event, the matter is pending since 2018. Therefore, it is expected that the learned trial Court would take appropriate measures to conclude the proceeding as expeditiously as possible.
With these observations, the revisional application is disposed of.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
