Mr. Ayan Banerjee Mr. Soumo Chaudhury ...for the petitioner Learned counsel appearing on behalf of the petitioner submits that the petitioner has preferred CAN No. 1 of 2004 with a prayer to modify and/or recall the order dated 19.02.2003 passed by the Hon'ble Justice Amitava Lala in WP 18458 (w) of 1998. The application is actually not in a proper form and therefore should be dismissed. In effect, this is an application for review or recall of an order passed by this Court. Therefore, this Bench does not have determination to take up the matter. However, the question of maintainability of the application is kept open. In view of the above, let this matter be released from my list for want of determination.
