D/L 62 30.07.2025 ct.no.35 Kausik W.P.A. 16480 of 2025 Asoke Kumar Biswas

Versus

State of West Bengal & Ors.

Mr. Sadhan Kr. Halder ...for the Petitioner.

Mr. Avirup Chatterjee Mr. Rishov Das ...for the private respondent.

Mr. Suman Ghosh ...for the State.

Learned advocate appearing for the petitioner is aggrieved by the fact that in spite of repeated directions by the learned Executive Magistrate in MP Case No. 723 of 2025 the police authorities are not submitting any enquiry report. Learned advocate for the private respondent submits that an absolutely civil dispute has been attempted to be given the cloak of a criminal proceeding.

Learned advocate for the State submits that on the next date so fixed police authorities would submit the report before the learned Executive Magistrate.

In view of the submissions made on behalf of the State, further pendency of the writ petition is unwarranted.

Accordingly, WPA 16480 of is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
