The State of West Bengal and others (Through Video Conference) Mr. Ramkrishna Bhattacharya, Mr. Kaushik Choudhury, Advocates ... for the petitioner Mr. Amitesh Banerjee, Senior Advocate Mr. Sirsanya Bandopadhyay, Mr. Subhendu Sengupta, Advocates ... for the State The present petition has been filed with the allegation that more than 75 ration cards have been issued for extending the benefit of the Rastriya Khadya Suraksha Yojana. The submission of the learned counsel for the petitioner is that only one person is drawing the benefits of 75 cards and in this regard the complaints were made to the concerned authorities on 10.09.2021, 08.09.2021 and 21.07.2021.

Learned counsel appearing for the State has submitted that on the basis of complaint so received, an enquiry has already been initiated. He submits that the respondent No.4 Sub-Divisional Controller, Food and Supplies is enquiring into the matter and on completion of the enquiry, appropriate steps will be taken to correct the anomaly, if any, pointed out by the petitioner. Learned counsel for the petitioner has sought an opportunity to produce relevant material before the respondent No.4 in this regard.

WPA (P) 296 of 2021 We find that enquiry is already initiated in which petitioner will also have opportunity. Hence we dispose of the present petition with a direction to the respondent No.4 to get the enquiry completed under his supervision through the concerned ADI who is enquiring the matter and in this process the respondent No.4 will also ensure an opportunity to the petitioner to produce all the relevant material in respect of alleged complaint and the said material will be taken into account in the process of the said enquiry.

Let this enquiry be completed within a period of 3 months from the date of communication of this order and the appropriate action on the basis of enquiry report be taken without any further delay after submission of the report. If any party remains aggrieved with the said enquiry report, he will be at liberty to take appropriate action.

Petition is accordingly disposed of.
