Shambhu Nath Bag and others The subject matter of challenge relates to order dated November 10, 2022 wherein the learned Judicial Magistrate, 1st Court, Tamluk, Purba Medinipur passed an order of interim maintenance of Rs.750/- each per month aggregating to a sum of Rs.1500/- per month to the opposite parties.

Having regard to the quantum of interim maintenance awarded, I am of the opinion that there is no scope for interference by this Court.

Accordingly, CRR 2569 of the 2023 is dismissed. However, so far as other issues are concerned, in course of the main proceedings under Section 125 of the Code of Criminal Procedure petitioner would be at liberty to agitate/canvass the points before the learned Magistrate and the learned Magistrate would consider the same in accordance with law. Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
